T\u00fcrk\u00e7ede izdiva\u00e7 i\u00e7in kullan\u0131lan \u201cEvlenme\u201d, \u201cEvlendirme\u201d kelimeleri, evlenen erke\u011fin ailesinden ayr\u0131larak kendine yeni bir \u201cEv\u201d yapt\u0131rmas\u0131n\u0131 ifade eder. Bu y\u00fczden \u0130bni Batt\u00fbta, Han\u2019\u0131n b\u00fcy\u00fck hatunundan d\u00f6rd\u00fcnc\u00fc hatununa kadar huzurunda bulunmu\u015ftur ve Hatunlardan hediyeler alm\u0131\u015ft\u0131r. Bunun yan\u0131 s\u0131ra \u0130bni Batt\u00fbta seyahatn\u00e2mesinde han\u0131n k\u0131z ve o\u011fullar\u0131na dair bilgileri de kaleme alm\u0131\u015ft\u0131r.<\/p>\n<p>\u0130lk yerle\u015fik hayata ge\u00e7en ve kadim T\u00fcrkler say\u0131lan Uygurlarda farkl\u0131 d\u00f6nemlerde kad\u0131nlar\u0131n yeri farkl\u0131 olmu\u015ftur. Buna \u00f6rnek olarak \u0130slam \u00f6ncesi Turfan Uygur Devleti\u2019ni ve \u0130slam sonras\u0131 olarakta Karahanl\u0131 Devletindeki kad\u0131n ve aile hakk\u0131nda bilgi sunmak istiyorum.<\/p>\n<p><strong>Turfan Uygur Devleti D\u00f6neminde <\/strong><strong>A<\/strong><strong>ile ve Kad\u0131n<\/strong><\/p>\n<p>Turfan Uygurlar\u0131nda \u201cLeviratus\u201dun devam etti\u011fini g\u00f6r\u00fcyoruz. \u00d6rne\u011fin: \u00d6geday d\u00f6neminde Amu nehri\u2019nin g\u00fcneyini idare eden Uygur veziri G\u00f6lcis, k\u00fc\u00e7\u00fck ya\u015fta babas\u0131n\u0131 kaybetmi\u015ftir. Bu y\u00fczden \u00fcvey annesi ba\u015fka akrabalar\u0131 olmad\u0131\u011f\u0131 i\u00e7in, hem zay\u0131f hem fakir oldu\u011fu i\u00e7in ba\u015fka bir erkekle evlenmek istemi\u015ftir. G\u00f6lcis bunu \u00f6\u011frenince \u0130dikut saray\u0131na gidip \u015fikayette bulunur. \u0130dikut Han, Uygurlar\u0131n Leviratus gelene\u011fine g\u00f6re, \u00fcvey annesinin kendisiyle evlenmesini buyrur. Numaral\u0131 vasikada: \u201c Otuz\u2019un Balitur adl\u0131 demirci k\u00f6lesi ile T\u0131yincoq\u2019un dokumac\u0131 k\u00f6lesi olan Ailik sahiplerinin iznini almadan evlendikleri i\u00e7in onlar\u0131 a\u011fr\u0131 \u015fekilde \u00e7al\u0131\u015ft\u0131rma cezas\u0131 verilsin\u201d diye yaz\u0131lm\u0131\u015ft\u0131r. 81. Numaral\u0131 vesikada ise: \u201cKutluk, Adar k\u0131z\u0131n\u0131 kendi hatunu yapabilmek i\u00e7in iki yastuk ve 20 dirhem g\u00fcm\u00fc\u015f \u00f6dedi hem de k\u0131z\u0131na k\u0131l\u0131f- k\u0131yafet ald\u0131. E\u011fer sonradan kavga \u00e7\u0131karsa, Han\u2019a 5 yastuk alt\u0131n, \u0130dikut\u2019a bir yastuk alt\u0131n, Ko\u00e7u Bal\u0131k\u2019taki bir vezire bir yastuk g\u00fcm\u00fc\u015f ceza \u00f6desin\u201ddiye yaz\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Yuan Hanedan\u0131 d\u00f6neminde, Ko\u00e7u \u015fehrinde k\u0131z bebeklerinin suda bo\u011farak \u00f6ld\u00fcr\u00fclmesi \u00e7ok rastalan\u0131yordu. 1276, Kubilay Han (Yuan Shi zu \u5143\u4e16\u7956) d\u00f6neminde, Turmi\u015fa adl\u0131 bir ki\u015fi k\u0131z bebe\u011fi suya att\u0131\u011f\u0131 zaman, \u015euan Kaya adl\u0131 ki\u015fi taraf\u0131ndan yerinde yakalanm\u0131\u015ft\u0131r. Bu dava ta Mo\u011fol ordusuna kadar gitmi\u015ftir. Kubilay, Uygurlardaki k\u0131z bebekleri \u00f6ld\u00fcrmemesi gerekti\u011fi hakk\u0131nda bir ferman \u00e7\u0131karm\u0131\u015ft\u0131r. Fermanda tam olarak: \u201ck\u0131z bebekleri \u00f6ld\u00fcren ki\u015finin mal varl\u0131klar\u0131n\u0131n yar\u0131s\u0131 al\u0131ns\u0131n ve o ki\u015fi ordu i\u00e7in hizmet etsin, k\u0131z bebekleri \u00f6ld\u00fcren ki\u015fiyi g\u00f6ren ve mahkemeye bildiren ki\u015fi k\u00f6le ise, azad edilsin. Yerli memurlar, k\u0131z bebekleri \u00f6ld\u00fcren insanlar\u0131 cezaland\u0131rs\u0131n\u201d diye yaz\u0131lm\u0131\u015ft\u0131r. 1227 tarihinde Kubilay Han yine Uygur \u0130dikut Han\u0131 Ko\u00e7gar\u2019a ferman vermi\u015ftir. Fermanda: \u201c kar\u0131 koca bo\u015fanmak istiyorsa, kocas\u0131 kar\u0131s\u0131na yaz\u0131l\u0131 bir belge veriyormu\u015f; kar\u0131s\u0131, kocas\u0131n\u0131n dede, nene ve ba\u015fka karde\u015flerinin izinsiz di\u011fer bir erkekle evlenmesine izin vermiyormu\u015f. Buna art\u0131k izin verilmesin, ortadan kalks\u0131n\u201d diye yaz\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p><strong>Karahanl\u0131 Devleti D\u00f6neminde Aile ve Kad\u0131n<\/strong><\/p>\n<p>Karahanl\u0131 Devleti\u2019nde Has Haciblik unvan\u0131n\u0131n alan devlet adam\u0131 Yusuf Has Hacib siyasetname ve ayn\u0131 zamanda \u00f6\u011f\u00fctname niteli\u011fini ta\u015f\u0131yan \u201cKutadgu Bilig\u201d eserinde evlik, k\u0131z-o\u011ful e\u011fitimi hakk\u0131nda bilgiler vermektedir. Yusuf Has Hacib eserinde yabanc\u0131lar\u0131 eve sokmamas\u0131 gerekti\u011fini, kad\u0131nlar\u0131 d\u0131\u015far\u0131ya \u00e7\u0131karmamak gerekti\u011fini, e\u011fer d\u0131\u015far\u0131ya \u00e7\u0131kmas\u0131na izni verirse yollar\u0131ndan \u015fa\u015faca\u011f\u0131n\u0131 dile getirerek, kad\u0131nlar\u0131\u00a0 karma\u015f\u0131k n\u00fcfusta evde tutman\u0131n daha uygun oldu\u011funu s\u00f6ylemi\u015ftir. M\u00fcellif eserinde yine kad\u0131nlara kar\u015f\u0131 baz\u0131 k\u00f6t\u00fcmser g\u00f6r\u00fc\u015flerini de ortaya koymu\u015ftur. \u00d6rne\u011fin: \u201ck\u0131zlar do\u011fmasa, do\u011farsa ya\u015famasa daha iyidir; kad\u0131nlar bir a\u011fa\u00e7t\u0131r, meyvesi zehirlidir, ona kar\u015f\u0131 bir i\u015ftiha besleme; nice bin erler kad\u0131nlar y\u00fcz\u00fcnden mahvolup gitmi\u015ftir\u201d gibi. M\u00fcellif yine \u201cEvlenme, evlenirsen denginle evlen, e\u011fer takva sahibi bir kad\u0131n bulursan f\u0131rsat\u0131 ka\u00e7\u0131rma derhal evlen\u201d diyerek kendi dengesindeki biri ile evlenmenin daha uygun oldu\u011funu s\u00f6ylemi\u015ftir. Do\u011fan k\u0131z-o\u011ful \u00e7ocuklara gelince, onlara bilgi ve edep \u00f6\u011fretilmesinin onlar i\u00e7in faydal\u0131 olaca\u011f\u0131n\u0131 s\u00f6ylemi\u015ftir.<\/p>\n<p>Karahanl\u0131 Devleti\u2019nde kad\u0131nlar yeri olduk\u00e7a a\u015fa\u011f\u0131dayd\u0131. Kad\u0131nlar evlendikten sonra e\u015finin \u00f6zel mal\u0131 olarak say\u0131l\u0131yordu. Kad\u0131nlar evlendikten sonra d\u0131\u015far\u0131ya \u00e7\u0131kmas\u0131na izin verilmiyordu, yabanc\u0131lar\u0131 eve alm\u0131yorlard\u0131, kad\u0131n ve erkekler ayn\u0131 sofrada oturup yemek yiyemiyordu. \u201cDivan-i Lugatit T\u00fcrk\u201dte, Karahanl\u0131lar Devleti d\u00f6neminde kad\u0131nlar\u0131n yabanc\u0131 erkeklere kendi y\u00fczlerini g\u00f6stermemsi i\u00e7in d\u0131\u015far\u0131ya \u00e7\u0131karken ba\u015flar\u0131na \u015fal art\u0131\u011f\u0131n\u0131 ve y\u00fczlerini \u00f6rtt\u00fc\u011f\u00fcnden bahseder.<\/p>\n<p><strong>Uygurlar Gelene\u011finde Miras Anlay\u0131\u015f\u0131<\/strong><\/p>\n<p>Uygurlar ailesi erkek- kad\u0131n ili\u015fkisi esas\u0131ndaki \u00e7ekirdek ailedir. Birden fazla \u00e7ocuklu ailelerde en k\u00fc\u00e7\u00fck o\u011flan\u0131, ya\u015fland\u0131\u011f\u0131 zaman kendilerini bakmalar\u0131 i\u00e7in evde kalmas\u0131n\u0131 isteyip di\u011fer b\u00fcy\u00fck o\u011flanlar\u0131n\u0131n evlendikten sonra ba\u015fka ev tutmalar\u0131n\u0131 izin veriyorlar. Tek \u00e7ocuklu ailelerde ise o\u011flan evlendikten sonra ba\u015fka ev tutmaz, anne babas\u0131yla beraber kal\u0131r. Miras taksimat\u0131na gelince, \u00f6rf- adet \u00e7er\u00e7evesinde k\u0131z \u00e7ocuklar erkek \u00e7ocuklar\u0131n ald\u0131\u011f\u0131 miras\u0131n yar\u0131n\u0131 al\u0131yordu. Kar\u0131- koca aras\u0131nda miras onlar\u0131n \u00e7ocuklar\u0131n\u0131n var yoklu\u011funa g\u00f6re taksim ediliyordu. Kocas\u0131 erken vefat etmi\u015fse ve \u00e7ocuklar\u0131 varsa, miras\u0131n 1\/8\u2019i kar\u0131s\u0131na, geri kalan k\u0131sm\u0131 \u00e7ocuklar\u0131na veriliyordu. \u00c7ocuklar\u0131 yoksa, miras\u0131n 1\/4\u2019i kar\u0131s\u0131na geri kalan k\u0131sm\u0131 erke\u011fin karde\u015flerine ve akrabalar\u0131na taksim ediliyordu. Kar\u0131s\u0131 erken vefat etmi\u015fse e\u011fer, miras\u0131n yar\u0131s\u0131 kocas\u0131na , yar\u0131s\u0131 kar\u0131s\u0131n\u0131n en yak\u0131n akrabalar\u0131na taksim ediliyordu. \u00c7ocuklar\u0131 varsa, miras\u0131n 1\/4\u2019i erke\u011fe, geri kalan k\u0131sm\u0131 \u00e7ocuklar\u0131na taksim ediliyordu. Evlad edinen k\u0131z o\u011fullar\u0131n\u0131n mirasa sahip olma haklar\u0131 yoktu. Babas\u0131 \u00fcvey olan \u00e7ocuklar sadece annesinin mal varl\u0131klar\u0131na sahip olabiliyordu.
